David J. Jencks

David Jencks is an attorney practicing primarily in the areas of commercial, transportation, business, real estate, and municipal law. David received his Bachelor of Arts degree from the University of South Dakota in 1996 and his Juris Doctor degree from Hamline University in May of 1999. David opened Jencks Law Office, P.C. in October of 1999 in Madison, South Dakota and practiced there since that time. After convincing his wife, Rachael, to marry him in 2002, they formed Jencks & Jencks, P.C.

David’s practice focuses primarily on real estate transactions of all types and sizes, representing municipalities as their general counsel, handling business transactions such as establishing new companies and assisting with their governance, drafting contract documentation and litigation of business disputes, and assisting transportation intermediaries and carriers in collections, contract documentation, and litigation. The majority of David’s practice involves working with factoring companies. In particular, David works with factors with transportation portfolios or those niche factors specializing primarily or exclusively in transportation. David currently works with approximately 20 factors in transportation factoring. He regularly assist with issues ranging from contract documentation, due diligence with prospects, field examinations, collections, and litigation, and personnel training. David also provides in house consultation services regarding operations, marketing and dealing with factoring documentation and associated transportation paperwork.

David is pleased to be a contributor to International Factoring Association training classes, newsletter, meetings and annual conferences regarding issues in transportation factoring.

David has served as a Trinity Lutheran Church trustee, president of the Madison Area Chamber of Commerce, president of the Interlakes Area United Way Board, and a board member of Refuge Youth Ministries. David and his wife, Rachael, practice law together and have two beautiful girls, Marissa, age 3 and Whitney, age 1.
